Terms of Service

These Terms govern your use of mangosports.com.au and purchases from ManGo Sports. They should be read together with our Shipping & Delivery Policy and Returns, Refunds & Warranty Policy. We handle personal information as described in our Privacy Policy.

ManGo Sports is a registered business name of DaTang Trading Australia Pty Ltd (ABN 65 141 377 068), an Australian business operating since 2010. References to “ManGo Sports”, “we”, “us” and “our” mean DaTang Trading Australia Pty Ltd trading as ManGo Sports.

Nothing in these Terms excludes, restricts or modifies any right, consumer guarantee or remedy that cannot lawfully be excluded. This includes rights under Australian Consumer Law and, for New Zealand customers where applicable, the New Zealand Consumer Guarantees Act and Fair Trading Act.

Using the website

You must use the website lawfully and must not interfere with its security, operation or other users. You must not attempt unauthorised access, introduce malicious code, misuse promotions, impersonate another person or use the website for fraudulent activity.

You are responsible for keeping account credentials secure and for information supplied through your account, unless the activity resulted from our failure to take reasonable care.

Product information

We aim to keep product descriptions, specifications, images, compatibility information, dimensions, prices and availability accurate. Colours and appearance may vary between screens, photography, production batches and updated packaging.

Please check the product information to determine whether an item is suitable for your intended use, available space, mounting method, size and experience level. If you tell us about a particular intended purpose and rely on our advice, nothing in these Terms limits any consumer guarantee that may apply.

Product information and buying guides are general information and are not professional medical, coaching, engineering or installation advice.

If we identify a material error in product information, availability or price before dispatch, we will contact you and explain the available options. Depending on the circumstances and applicable law, this may include correcting the information, offering an alternative, or cancelling and refunding the affected item.

Prices, currency and payment

Prices are shown in the currency displayed on the website and at checkout. Prices displayed for Australian orders include GST where applicable.

Shipping charges and any other amounts collected by ManGo Sports are shown before payment. Currency-conversion charges, card-provider fees, customs duties, import taxes or other government charges imposed separately are not included unless expressly stated.

Available payment methods are displayed at checkout. Payments may be processed by Shopify or other payment providers under their applicable terms and privacy policies.

You confirm that you are authorised to use the payment method supplied. An order may not proceed if payment cannot be authorised or completed.

Orders and availability

Placing an order submits an offer to purchase the products in your cart. An automatic order confirmation acknowledges that we received your order but does not necessarily mean the order has been accepted. We accept an order when we confirm dispatch or otherwise tell you that it has been accepted.

Before accepting an order, we may decline or cancel it for genuine and reasonable grounds, including payment failure, suspected fraud, stock unavailability, delivery restrictions, an obvious pricing or product-information error, misuse of a promotion, or a legal requirement.

If we cannot accept an order after receiving payment, we will notify you and refund the affected amount to the original payment method.

A product shown online may become unavailable before the order is accepted. If this occurs, we will contact you and explain the available options.

ManGo Sports manages order dispatch through a multi-location network. Products in the same order may therefore be dispatched separately and arrive in different parcels or on different days. Tracking details will be provided for each parcel where available.

Delivery and ownership

Delivery options, charges, estimates and restrictions are explained in our Shipping & Delivery Policy and at checkout. Delivery estimates are not guarantees unless we expressly state otherwise.

Where ManGo Sports arranges delivery, we remain responsible for the delivery service until the order is delivered to the address supplied for the order, subject to applicable law. If an order is delayed, lost or damaged in transit, please contact us and we will investigate with the carrier and relevant dispatch team.

Please check the delivery address carefully before placing your order. Contact us immediately if it is incorrect. We cannot guarantee that an address can be changed after fulfilment has started.

Ownership of a product passes to you after the product has been paid for in full and delivered. Nothing in this section limits any rights or remedies available under applicable consumer law.

Returns, faults and refunds

Returns, change-of-mind conditions, damaged deliveries, incorrect products, warranty claims and product faults are handled under our Returns, Refunds & Warranty Policy.

Please contact ManGo Sports and wait for return instructions before sending or bringing back a product.

Nothing in these Terms or our Returns, Refunds & Warranty Policy excludes, restricts or modifies any consumer right or remedy that cannot lawfully be excluded. Depending on the circumstances, remedies for a faulty, unsafe, damaged, incorrectly supplied or misdescribed product may include a repair, replacement, refund, compensation or another remedy available under applicable consumer law.

Product safety, assembly and use

Please use products only for their intended purpose and follow all supplied warnings, weight limits, age guidance, care, installation and assembly instructions.

Some products require assembly, secure mounting or installation. Make sure the product and installation location are suitable, and obtain assistance from a competent adult or qualified installer where appropriate.

Combat sports, fitness activities and sporting equipment can involve risk. Appropriate instruction, supervision, protective equipment and medical advice may be necessary depending on the activity and the user.

To the extent permitted by law, ManGo Sports is not responsible for damage or injury caused by misuse, unauthorised modification, unsuitable installation or failure to follow clear product instructions. Nothing in this section limits any liability, consumer right or remedy that cannot lawfully be excluded.

Promotions and discount codes

Promotions and discount codes may have specific eligibility requirements, dates, product exclusions, minimum-spend requirements and usage limits. Any specific conditions displayed with an offer form part of these Terms.

Unless stated otherwise, discount codes cannot be combined, exchanged for cash or applied to an order already placed. A discount applies only to eligible products and does not reduce delivery charges unless the offer expressly says otherwise.

We may refuse or cancel a promotion or discount where there is fraud, misuse, duplication, an obvious technical error or another genuine and reasonable basis, subject to applicable law. If this affects an order for which payment has already been taken, we will contact you and refund any affected amount where appropriate.

Intellectual property

Unless otherwise stated, the ManGo Sports website, branding, design, written content, graphics and other original materials are owned by DaTang Trading Australia Pty Ltd or used with permission.

You may access and use the website for personal shopping and reference. You must not copy, reproduce, republish, modify, distribute or commercially exploit protected website material without permission, except where permitted by law.

Product names, brand names, logos and trademarks belonging to manufacturers or other third parties remain the property of their respective owners. Their appearance on our website identifies the relevant products and does not by itself imply sponsorship, endorsement, authorised-reseller status or another commercial relationship.

Third-party services and links

Our website may link to or use third-party services, including payment providers, delivery carriers, review platforms, social media services and product resources. These services may have their own terms and privacy policies.

ManGo Sports does not control independent third-party websites or their content and practices. Nothing in this section limits any consumer right or remedy that cannot lawfully be excluded.

Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, including under Australian Consumer Law and, where applicable, New Zealand consumer law.

To the extent permitted by law, ManGo Sports is not responsible for loss or damage to the extent caused by misuse, unauthorised modification, incorrect assembly or installation, or failure to follow clear product and safety instructions.

Any limitation of liability applies only to the extent permitted by law and does not affect a customer’s non-excludable rights or remedies.

Changes, suspension and termination

We may update this website and these Terms to reflect changes to our services, business practices or legal obligations. Changes apply from the updated effective date and will not alter the terms of an order we have already accepted unless required by law or agreed with you.

We may temporarily suspend access to all or part of the website where reasonably necessary for security, maintenance, fraud prevention or legal compliance. Where practical, we will provide notice and restore access as soon as reasonably possible.

We may restrict or terminate access where there is serious or repeated misuse, fraudulent or unlawful activity, or interference with the website’s operation. This does not affect either party’s existing rights or remedies relating to an order already placed.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

If you are located in New Zealand or another jurisdiction, any mandatory consumer protections that apply to you remain unaffected.

You and ManGo Sports submit to the non-exclusive jurisdiction of the courts of New South Wales and any other court that has jurisdiction under applicable consumer law.
